Food Hygiene Safety Legal Requirements

The Food Hygiene (England) Regulations 2005 and the Food Safety Act 1990 require food business owners to ensure their products are safe to eat, of acceptable quality, and properly labelled.

The UK Food Standards Act 1999 requires anyone who works with or handles food to have a very good understanding of food hygiene safety, how to clean food preparation areas, premises cleaning, disinfect equipment, safety store food, freeze food safely, personal hygiene, pest control, and keep up-to-date with the latest food safety regulations.

This is a minimum legal requirement (UK) for anyone who works with or handles food, including managers, supervisors, and business owners. It is very important that you ensure that you and your employees are compliant with the latest food safety legislation or regulation, because this could negatively impact you or your business.

Food Hygiene Safety Compliance

Natasha’s Law

Natasha’s Law is named in memory of Natasha Ednan-Laperouse, who tragically died in 2016 due to an allergic reaction to undeclared allergens in a pre-packaged sandwich. The law, officially known as the Food Information Amendment (England) Regulations 2019, requires food businesses to provide clear and accurate labelling on pre-packaged foods, specifically emphasising the presence of 14 major allergens.

This legislation aims to enhance consumer safety and awareness regarding allergenic ingredients in pre-packaged food products.

Course Certification

Once you have successfully completed the Food Safety Level 2 Awareness Course, a quality-assured certificate will be immediately available online for you to download at your leisure.

CPD Certification: Our course is accredited by the CPD Certification Service and aligns with universally accepted Continuing Professional Development (CPD) guidelines.

This food safety certification is recognised nationwide as proof that you have completed the necessary food hygiene safety training and can be provided as evidence to external auditors, such as Environmental Health Officers.

This certificate is universally accepted across the hospitality and catering industry and is valid for three years. This food hygiene safety certificate must be renewed every three years, and in exceptional circumstances, it may need to be renewed more often.

Food Safety Legislation and Regulations

The Food Safety Act of 1990 is an important legal instrument that helps to ensure the overall safety and integrity of the UK food supply chain. The law has been revised and supplemented by later legislation, which handles developing concerns and assures the continued protection of public health.

The Food Safety and Hygiene (England) Laws 2013 are a series of laws that control food safety and hygiene practices in England. These regulations were enacted to implement specific sections of EU legislation, specifically Regulation (EC) No. 852/2004 on food hygiene.

Food Business Operators (FBOs): The regulations require food business operators to guarantee that food safety and hygiene standards are met throughout the manufacturing, processing, distribution, and sale of food.

Hazard Analysis and Important Control Point (HACCP) System: FBOs are frequently obliged to install a HACCP system, which entails detecting and controlling possible hazards at important stages in the food production process.

This Level 2 Food Hygiene course takes between 1 and 2 hours to complete, although it is flexible so it can be completed at your own pace in numerous sessions if you wish.

The assessment usually takes 10-20 minutes depending on your speed, but again it is flexible so you can complete it more quickly or take longer depending on your individual needs.

Students have access to the course for up to 12 months and the course can be completed or retaken at any point in this time period.

While a Level 2 Food Safety Certificate does not technically expire, Environmental Health Officers strongly advise that food hygiene training should be refreshed regularly. This is crucial for maintaining up-to-date knowledge and practices in food safety.

There is no expiry date for this certificate, however you may want to refresh the course periodically. The timescale for a refresh depends on the type of course that is being taken and the nature of your business. Ideally, the refresh regularity should be based on a thorough risk assessment of your business and tailored to the unique needs of your organisation and customers (if you are unsure how to complete a risk assessment, you can learn more by completing our Risk Assessment Awareness course).

If you are looking for a general rule for refresh training, every 12-18 months is good practice for the courses that Learn Q offer (we will also email you a reminder when you approach the recommended refresh date).

Please keep in mind the following exclusions:

  • In the case of an internal incident- if there has been an incident within your business where an employee, a customer or a client has been injured then this then means that it is important to refresh all colleagues with the relevant training to minimise the chance of it happening again. 
  • In the case of an external incident- if there has been an incident outside of your business, but within your industry then this could be a time to refresh relevant training. Of course, this will only be applicable if the incident is severe, and you think that it poses a risk to your business and those who work within it and those who are clients. At the very least, it is going to be worthwhile refreshing their Health and Safety training. 
  • If a process changes- if an internal process has changed, then it is going to be a good time to refresh any training that relates to this process. Particularly if you feel that it might impact what has been previously learnt.
  • If you bring in new equipment- if you introduce new equipment, you should provide training that is relevant to this change. Even if the change is slight; after all, prevention is always better than cure. 
  • If there has been a change in the environment- if you move premises or have some changes made to where you work, then you will need to think about some of the training. This includes COSHH and Health and Safety.

This is an ‘entry level’ course, meaning there are no barriers for entry. You do not need any prior learning, qualifications or certificates to take this course and it is suitable for all.
